Please read this Liability Waiver carefully before scheduling services with Sweet Trees Hawaii LLC. By scheduling or accepting services, you acknowledge that you have read, understood, and agree to the terms below.

1. Scope of Services

Sweet Trees Hawaii LLC ("Sweet Trees Hawaii," "we," "our") provides fruit tree care services including but not limited to routine pruning, fertilization, pest management, soil amendments, grafting, air-layering, and related horticultural services for residential fruit trees on Oahu, Hawaii.

2. Assumption of Risk

You ("Client") acknowledge that fruit tree care involves inherent risks including but not limited to:

• Damage to trees resulting from pre-existing disease, structural weakness, or conditions not discoverable through visual inspection
• Natural variation in tree response to pruning, fertilization, or grafting
• Tree loss due to existing pest infestation, disease, drought, or other environmental factors beyond our control
• Accidental damage to surrounding structures, landscaping, or property during service

Client assumes all risk associated with normal fruit tree care operations performed within accepted horticultural practice.

3. Limitation of Liability

Sweet Trees Hawaii LLC shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of fruit production, tree death, or property damage arising from services rendered in good faith and in accordance with standard horticultural practice.

Our total liability to Client for any claim arising out of or related to services provided shall not exceed the total amount paid for those specific services.

4. Large Tree & Structural Work

Sweet Trees Hawaii provides care for fruit trees within the scope of regular horticultural maintenance. Significant structural pruning, tree removal, or work on mature trees 20 feet and above requires a licensed arborist and is outside our regular service scope. We will identify these conditions at assessment and communicate them clearly. Work of this nature is subject to a separate quote and agreement.

5. Property Access

Client grants Sweet Trees Hawaii LLC permission to access their property for the purpose of providing scheduled services. Client is responsible for ensuring clear, safe access to trees and for disclosing any known hazards on the property prior to service.

6. Indemnification

Client agrees to indemnify, defend, and hold harmless Sweet Trees Hawaii LLC, its officers, employees, and contractors from any claims, damages, or expenses arising out of: (a) Client's misrepresentation of property conditions; (b) Client's failure to disclose known hazards; or (c) Client's interference with or modification of services after they are performed.

7. Photography & Media

Sweet Trees Hawaii may photograph trees and property for documentation, quality assurance, and marketing purposes. Client may opt out by providing written notice to [email protected] prior to the first service visit.

8. Governing Law

This waiver shall be governed by the laws of the State of Hawaii. Any disputes arising under this waiver shall be resolved in the appropriate courts of the State of Hawaii.
